TERMS OF USE
Welcome to the Architecture in Development website. We’re happy to see that you want to join our community and contribute to the site. Before we can grant you access, we would like to set out certain rules that help keep our community functioning well. Please read these rules carefully so you know what your rights and obligations are.
REGISTRATION RULES
To use the website you need an account, which is tied to your email address. Upon creating an account we will email you your temporary password. Please guard this password carefully and do not share it with others. You are responsible for all actions performed using your account – except if you notify us that your account has been compromised.
Using your account you can configure your profile, which includes information about yourself that will be used on various parts of the website. You are free to use a pseudonym as your public identifier on the website, but please do not use someone else’s name or a company name unless you are authorized by that person or company to do so. All information that you enter must be correct and complete.
Please do not share accounts. If you represent a group or company, you should still use your own name together with the group’s name.
If we see suspicious behaviour, such as multiple logins from different IP-addresses, we may temporarily block your account until we can resolve our concern.
If you do not log in at least once every twelve months, we may disable or remove your account
and assign authorship of any and all of your pages to someone else.
If you do not edit a project-page for which you are the chief author editor at least once every twelve months, we may invite you to select another user who can take over this role. However if you do not do so before the end of this period, we reserve the right to decide at our discretion who will take over the status of chief editor for those pages.
Note that a number of additional regulations apply to participants in our periodic Global Challenge.
CONTRIBUTIONS RULES
This website is open to all users and consequently will contain a multitude of opinions and other content. We welcome an open debate but we do not necessarily endorse any particular opinion or recommendation published by users. The fact that we do not screen or remove any particular publication does not imply we support its point of view. We accept no liability for any particular content on the website.
You are free to decide which materials you want to publish on the various channels, such as forum discussions, photos, Wiki texts, blog posts, reviews and a personal profile of yourself. However, content must be relevant for Architecture in Development. Irrelevant content, such as politically motivated posts, sexual content or commercial messages, is not allowed.
We do not always screen or moderate your publications in advance, except when you create a new project page or article. In that case we review your contribution before publishing the information. Our approval in such a case does not constitute an acceptance of liability or an approval of the position taken in your content.
We do ask that your publications are accurate to the best of your knowledge. You agree to not intentionally add false information, or change or remove existing information without good reason.
Further, your contributions may not violate applicable laws and regulations. For example, we do not allow defamatory, libelous, harassing, threatening or otherwise objectionable content, copyright or trademark infringements, the posting of chain letters, Ponzi schemes or multi-level marketing systems or malicious content such as spyware or viruses.
In case your are a business and you wish to post commercial messages, you need to get specific permission from us beforehand. However, you are free to contribute in any other way.
We may block, adapt or remove any publication by you if we determine that such publication is likely to be unlawful or in violation of these terms of use. We do not need to consult or inform you in such a case. In serious cases or with repeat offenders we may remove your account. You agree to fully indemnify us in case we (or any third party) suffer any damages as a result of your publications.
COPYRIGHT RULES
We respect the intellectual property of others, and we expect you to do the same. We do not claim ownership of any materials you publish on this website. You may only use published materials in accordance with the applicable license conditions or with separate express permission from the author.
By contributing to this website, you hereby grant us and other recipients of the above materials a license to your contributions under the Creative Commons-Attribution-ShareAlike Unported license version 3.0 as published by the Creative Commons at http://creativecommons.org/licenses/by-sa/3.0/, or any successor license thereof. In specific situations (such as when uploading images) we may allow you to choose another license. Any license you grant is perpetual and irrevocable. Further, in any case you authorize us to transcode, crop and/or resize any image or video you upload and to overlay images or videos with text. You guarantee to us that you fully own all rights to your publications and that you are permitted to grant the above license without any further obligations or restrictions.
In case you publish materials to which third parties hold the copyright, you represent and warrant that you have the right to sublicense these materials under this license or that the copyright holder permits the use of these materials under this license.
AVAILABILITY OF THE WEBSITE
We will use our best efforts to keep the website available at all times, but we cannot guarantee a 100% availability.
We may adapt the website and associated hard- and software to correct errors and to improve the functionality. We may temporarily disable access to the website or parts therefore for the purposes of maintenance or upgrades to the website and related systems. We will strive to schedule such maintenance or upgrades during times when average usage of the website is low and will announce such maintenance or upgrades in advance if possible.
LIMITED LIABILITY
As the website is offered to you free of charge, we are liable to you only for damages as a result of our intentional misconduct or gross negligence towards you.
We accept no liability for contributions made by other users. We will investigate any complaints and decide at our discretion what to do.
COLLABORATIVE CONTENT
Part of the website is operated as a set of community-grown 'living' documents which all members may edit (if granted permission by the chief author or A--ID itself). In addition to the general rules regarding your contributions, contributing to such documents means that you accept that others may mercilessly change and add to your contributions.
If you create a new document (Inspiration), you become 'chief author' and you get to choose your 'co-authors'. As chief editor you have the final say on the content of that document, but please respect the contributions of your co-authors. You can transfer your status as chief author to others. Such transfer is final; you cannot demand to be returned to the status of chief author
These documents are created by the community and represent the view of the community, rather than an individual author. You must accept that your individual contributions will not be attributed to you. Further, even if you create a document you do not have the final say in its content.
Please do not remove entire pages, make massive changes without discussing them or engage in “edit wars” with other contributors. Such behaviour may lead to your being banned from contributing here.
FINAL REMARKS
These terms – and your use of the website – are subject to Dutch law.
We may change these terms as the website develops. We will announce our changes at least two months in advance and give you an opportunity to respond. We will seriously consider your feedback.
However, if we do go ahead with a change that you disagree with, you must cancel your account before the changes take effect. Use of the website after those two months constitutes acceptance of the changes.
Oh, and by the way, even though we say “please” a lot we are serious about these rules and we will enforce them if necessary. Our decisions are final. If you do want to go to court, you will have to use the courts of Amsterdam, the Netherlands.
